Terms of Service

Welcome to AwayBase. These Terms of Service (“Terms”) govern your access to and use of the AwayBase platform, including our website, applications, and services. By creating an account or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our platform.

1. Account Registration

To use AwayBase, you must create an account. When you register, you agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information to keep it accurate
  • Maintain the security of your password and account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately if you suspect unauthorized access to your account

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use our services.

2. Use of the Platform

AwayBase provides tools for creators to build digital storefronts, sell digital products, and manage their online business. You agree to use the platform only for lawful purposes and in accordance with these Terms.

You may not:

  • Use the platform to sell illegal, fraudulent, or infringing content
  • Upload or distribute malware, viruses, or harmful code
  • Interfere with or disrupt the platform or its infrastructure
  • Attempt to gain unauthorized access to other accounts or systems
  • Use automated tools to scrape, crawl, or extract data from the platform without permission
  • Impersonate another person or entity, or misrepresent your affiliation
  • Violate any applicable laws, regulations, or third-party rights

3. Digital Products and Content

As a creator on AwayBase, you retain ownership of the digital products and content you upload. By uploading content, you grant AwayBase a non-exclusive, worldwide license to host, display, and distribute your content solely for the purpose of operating and providing the platform.

You represent and warrant that you own or have the necessary rights and permissions to upload, sell, and distribute any content you make available through the platform, and that your content does not infringe upon the intellectual property rights of any third party.

4. Payments and Fees

AwayBase processes payments through Stripe. By using our payment features, you also agree to Stripe's terms of service.

  • Subscription fees are billed on a recurring basis as described at the time of purchase
  • All fees are non-refundable unless otherwise stated or required by law
  • We reserve the right to change our pricing with reasonable notice to existing subscribers
  • You are responsible for all applicable taxes related to your use of the platform
  • Transaction fees and payout schedules are determined by your plan and Stripe's processing terms

5. Refunds and Disputes

Creators are responsible for setting their own refund policies for the products they sell. AwayBase may assist in facilitating refund requests but is not responsible for disputes between buyers and sellers. We reserve the right to mediate disputes and issue refunds at our discretion to maintain the integrity of the platform.

6. Intellectual Property

The AwayBase platform, including its design, code, features, branding, and documentation, is owned by AwayBase and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our platform without prior written consent.

7. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the platform or other users.

You may close your account at any time through your account settings. Upon termination, your right to access the platform will cease immediately. We may retain certain data as required by law or for legitimate business purposes.

8. Limitation of Liability

To the maximum extent permitted by law, AwayBase shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the platform. Our total liability for any claim related to these Terms shall not exceed the amount you paid to AwayBase in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The platform is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not guarantee that the platform will be uninterrupted, error-free, or secure. You use the platform at your own risk.

10. Indemnification

You agree to indemnify and hold harmless AwayBase, its officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorney fees) arising out of your use of the platform, your content, or your violation of these Terms.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the platform after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AwayBase operates, without regard to conflict of law principles.
